The intersection between film and copyright
While learning about film and being in the field, I never learned much about the law–specifically, copyright. It was always a topic that appeared to be spoken about with nothing actually being said. Professor's would say something about fair use and then proceeded to assume that we all understood what that meant and that was sufficient... It never was.
My goal is to explain the basics of copyright so that anyone in or out of the film industry can understand it. What is copyright, how is it secured, and what protections and rights come with it? These are all basic questions that you will have the answer to. You will be educated on the simple ins and outs enough to at least know what you're talking about when you need to speak with a lawyer or negotiate a distribution deal.
I want you to be protected.
Copyright is a type of intellectual property that protects original works of authorship as soon as an author fixes the work in a tangible form of expression. In copyright law, there are a lot of different types of works, including paintings, photographs, illustrations, musical compositions, sound recordings, computer programs, books, poems, blog posts, movies, architectural works, plays, and so much more!
There are many types of authorship, some of which depend on the type of work being created. The most common is solo authorship. Then joint authorship is when there are two or more authors for a work. Then there are works made for hire and collective works which are owned by the hiring party.
Artificial Intelligence cannot be an author of a work. Only humans have the right.
You can absolutely use AI as a tool to help you create, organize, and develop your work. However, AI cannot be making the creative decisions and ultimately make the work.
